Sent the email and got a response pretty quick. EMAIL:"Thank you for your interest in Hay Ck and changing the stream to a DHALO Area. Off and on I have heard this mentioned by fly anglers, but the fact is that there are a number of reasons why we would not manage this stream as a DHALO Area within the presently stocked section. Primarily, Hay Creek is one of the most popular stocked trout streams in Berks Co, along with Manatawny, the Tulpehocken, and perhaps Northkill. As such, we would not be willing to change the management there to DHALO and disappoint a large number of anglers who are used to and look forward to the regular trout stocking program on that stream. Additionally, and possibly a contributing factor to its popularity, it is one of the few stocked streams with a long stretch of public land in Berks Co. The other major one is the Tulpehocken DHALO area and the inseason stocked section below that DH Area. With limited public land along stocked trout streams we don’t wish to tie too many of these waters up with more restrictive regulations than the statewide regulations. Hay Ck also suffers from low flows in late spring and frequently warm water temperatures downstream towards and through Birdsboro. This has on occasion been a problem for late spring or very early summer stockings of adult trout, particularly when we have had “left-over” trout in the hatcheries to distribute after Memorial Day. Those conditions would not be good for a DHALO area and its associated high stocking rate.
While we would not oppose the idea of an additional DHALO Area in Berks Co, well removed from the geographical area of the Tulpehocken, we have not found a suitable stream or stream section. While Manatawany is sometimes mentioned by anglers, it is a very popular stream in its own right and presently serves the angling public well with its length, size, and for fly anglers, its reputation for good hatches at a time of year when many anglers have quit trout fishing. Ideally, we could “rescue” a presently posted section for such a program and not remove any popular, unposted stretches from the general trout stocking program, but the posted stretches have poor parking and access. We have looked into it. Likewise, we have looked into a segment of Swamp Ck near Bechtelsville and a segment of West Branch Perkiomen Ck just across the county line with no success regarding landowner permission in one case and a problem with proximity to public roads and parking in the other.
Finally, given the lengths of Hay Creek and its tributary, Beaver Run, that are Class A wild trout stream sections, I would think that by seeking landowner permission, you would be able to find some good stretches to fish over fairly high density wild trout populations.
I appreciate your suggestion of Hay Creek, as it does stay cool towards the upper half of the walk-in segment, but I will not be adding the stream to the DHALO program for the reasons mentioned above."

I would think a creek like Hay with a dhalo section would draw in more attention because it would mean it is a better section of stream? Also, the part about the temps in Birdsboro is completely irrelevant... It's good that it's public, it only makes it easier to designate the regualation. Besides, what's a sign to say some kid can't keep a trout?

Been obsessed with this Beaver Run the State guy mentioned.
I knocked on a door to get permission but no answer. Scouted around and found a VERY interesting spot that is not posted.

Beaver Run is what talked about here. It starts over near Plowville and flows into the Hay near White Bear Rd. I would hazzard a guess that it flows over ALL private lands so you need to get permission GOOD LUCK WITH THAT.
